  • Personnel: refers to those individuals who are employed by MindSpaceX or are under contract to perform a service on behalf of one of the parties.

  • Personal Data: any information that directly, indirectly, or in connection with other information — including a personal

    identification number — allows for the identification or identifiability of a natural person.

  • Service: refers to the service provided by MindSpaceX as described in the relative terms (if available) and on this platform.

  • Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide

    our content or whose products or services we think may interest you.

  • You: a person or entity that is registered with MindSpaceX to use the Services.

Information automatically collected

There is some information like your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our platform. This information may be used to connect your computer to the Internet. Other information collected automatically could be a login, e-mail address, password, computer and connection information such as browser plug-in types and versions and time zone setting, operating systems and platforms, purchase history, (we sometimes aggregate with similar information from other Users), the full Uniform Resource Locator (URL) clickstream to, through and from our Website that may include date and time; cookie number; parts of the site you viewed or searched for; and the phone number you used to call our Customer Services. Personnel

If you are a MindSpaceX worker or applicant, we collect information you voluntarily provide to us. We use the information collected for Human Resources purposes in order to administer benefits to workers and screen applicants.

You may contact us in order to (1) update or correct your information, (2) change your preferences with respect to communications and other information you receive from us, or (3) receive a record of the information we have relating to you. Such updates, corrections, changes and deletions will have no effect on other information that we maintain, or information that we have provided to third parties in accordance with this Privacy Policy prior to such update, correction, change or deletion.

Sale of Business

We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of MindSpaceX or any of its Corporate Affiliates (as defined herein), or that portion of MindSpaceX or any of its Corporate Affiliates to which the Service relates, or in the event that we discontinue our business or file a petition or have filed against us a petition in bankruptcy, reorganization or similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.

Affiliates

We may disclose information (including personal information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity which directly or indirectly controls, is controlled by or is under common control with MindSpaceX, whether by ownership or otherwise. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Corporate Affiliates in accordance with the terms of this Privacy Policy.

Governing Law

This Privacy Policy is governed by the laws of Denmark without regard to its conflict of laws provision. You consent to the exclusive jurisdiction of the courts in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy except for those individuals who may have rights to make claims under Privacy Shield, or the Swiss-US framework.

The laws of Denmark, excluding its conflicts of law rules, shall govern this Agreement and your use of the website. Your use of the website may also be subject to other local, state, national, or international laws.

By using MindSpaceX or contacting us directly, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should not engage with our website, or use our services. Continued use of the website, direct engagement with us, or following the posting of changes to this Privacy Policy that do not significantly affect the use or disclosure of your personal information will mean that you accept those changes.

MindSpaceX uses "Cookies" to identify the areas of our website that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our website but are non-essential to their use. However, without these cookies, certain functionality like videos may become unavailable or you would be required to enter your login details every time you visit the website as we would not be able to remember that you had logged in previously. We collect information from kids under the age of 13 just to better our services. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

At MindSpaceX we strongly believe that your data privacy is very important and we already have solid security and privacy practices in place that go beyond the requirements of this new regulation.

Individual Data Subject's Rights - Data Access, Portability and Deletion

We are committed to helping our customers meet the data subject rights requirements of GDPR. MindSpaceX processes or stores all personal data in fully vetted, DPA compliant vendors. We do store all conversation and personal data for up to 6 years unless your account is deleted. In which case, we dispose of all data in accordance with our Terms of Service and Privacy Policy, but we will not hold it longer than 60 days.

We want your booking with us to run as smoothly as possible. In order to provide a great level of service to all of our clients and delegates, we have some terms and conditions that you will need to agree to when booking. These terms and conditions offer a level of protection to both you and our business.

How to Book

Please ensure you have read, understood and accepted the Conditions of Booking before you submit a booking. By placing a booking you will be deemed to have read, understood and accepted them, therefore entering into a contract.

To make, amend or cancel a booking please use the live booking system on our website or app or email us at booking@mindspacex.com.

Once your request is received and processed and you receive a booking email from us, your booking in then classed as a confirmed booking and the terms and conditions below apply. By completing this form you are entering into a contract with us.

Although you have received a confirmation on your booking, your space(s) on the course you have selected will only be confirmed if you have a valid membership with no outstanding fees.

Methods of Payment

Payment of the course fees must be made in advance and should be made at the time of placing a booking or immediately after receiving an invoice. This applies to single course payments only and not to members with a current monthly membership.

Course payments can be made only via the websites online payment portal and all transactions are immediate and final.

 

Cancellation – Online Classes

Whether or not course fees have been paid or a client holds a monthly membership, cancellation fees will apply once the booking has been processed.

Bookings can only be cancelled via the my account section of the website.

  • Cancellations are not possible within 30 min of the training start time/date.

  • Cancellations more than 30 min. in advance of the course will incur no charge or penalty.

  • No shows on the day without any notice will be classed as cancelling within 30 min. of the session.

  • A member who, three (3) times in 60 days, have cancelled within 30 min. of a session, as per the terms above, will be have his/her booking rights revoked.

 

To ensure a consistent service is provided to all, this is non-negotiable.

Cancellation – One-to-One lessons / personal tutoring

Bookings can only be cancelled by completing the cancellation form in the my account section of the website.

  • Cancellations within 24 hours of the training start time/date will be charged the full course fee or debited from his/hers allowable course balance.

  • Cancellations more than 24 hours in advance of the course will incur no charge.

  • No shows on the day without any notice will be classed as cancelling on the day within 24 hours.

Cancellation – Free Webinars

Webinars can be cancelled at any time. Attendance is not necessary and access to a recording will be available for active bookings.

Booking Transfers

Bookings are non-transferrable.

Course Content and Programme Schedule

MindSpaceX reserves the right to alter the advertised schedule of courses, which may include cancellation of a course.

All advertised programmes require a minimum number of participants. Where this number is not reached, we may choose to cancel the course. Where MindSpaceX cancels a course a 4-day notice must be provided.

MindSpaceX reserves the right to alter or amend the advertised content of any course without notice in order to continuously provide a high quality service or due to circumstances beyond our control.

MindSpaceX reserve the right to change the venue from that originally advertised by providing 4 days notice.

MindSpaceX will not be liable for any losses or expenses, including consequential, arising from any such alterations or amendments to the programme content and schedule including cancellation.

 

Acceptable Use of Facilities

In placing a booking you agree to abide by MindSpaceX’s Acceptable Use Policy relating to the use of MindSpaceX’s facilities. This policy requires the following:

  • None of MindSpaceX’s facilities may be used to locate, display or transmit any material which is illegal or offensive,

  • No software may be downloaded or installed on any of MindSpaceX’s computing equipment unless under the explicit direction of the MindSpaceX platfrom,

  • No data may be imported which has not been checked for viruses and which is not under the explicit direction of the MindSpaceX platform,

 

Exclusion

MindSpaceX reserves the right to refuse access to its facilities and premises where there is reason to believe that a delegate is in breach of these conditions or where a delegate uses threatening, bullying, harassing or disruptive behaviour. MindSpaceX will not be liable for any losses or expense (including course fees and consequential damages) incurred by a delegate arising from such an exclusion.

Digital and Online Training Facilities

MindSpaceX will provide access to our online training platforms in order for delegates to attend an online training course.

Charges for online training are per delegate and not per connection. Where we suspect more than one person is using a connection to our digital services, we reserve the right to terminate and block the connection without refund.

We will publish the minimum software and hardware requirements for accessing our online and digital services. It is the delegates responsibility to check these prior to the course and cancel within the required timescales where these cannot be met.

Revolution Learning and Development will not be responsible for failures to connect due to software or hardware requirements not being met, internet drop-outs or failures, issues with firewalls or being unable to download the required software due to internal security policies.

Free Webinars and Other Online Services Offered Free of Charge

MindSpaceX will from time to time offer some online and digital services free of charge.

Where this is the case we use an email marketing list programme to collect and manage registrations including sending joining instructions. This data will also be added to our main marketing list and used to send further communications after the event where we think the delegate will be interested in the content. Information can be unsubscribed at any time.

MindSpaceX (“we” and “us”) is the operator of https://www.mindspacex.com (“Website”) which is the main distributor the Airline Transport Pilot: Complete Note Collection book. By placing an order through this Website or through our redirect site www.theATPbook.com you will be agreeing to the terms below. These are provided to ensure both parties are aware of and agree upon this arrangement to mutually protect and set expectations on our service.

 

Shipping Costs

Shipping costs are calculated during checkout based on weight, dimensions and destination of the items in the order. Payment for shipping will be collected with the purchase. This price will be the final price for shipping cost to the customer and includes VAT and most customs fees.

 

Returns

RETURN DUE TO CHANGE OF MIND

MindSpaceX will happily accept returns due to change of mind as long as a request to return is received by us within 14 days of receipt of item and are returned to us in original packaging, unused and in resell-able condition. Return shipping will be paid at the customers expense and will be required to arrange their own shipping. Once returns are received and accepted, refunds will be processed to store credit for a future purchase or to the credit card used for the transaction. We will notify you once this has been completed through email.

(MindSpaceX) will refund the value of the goods returned but will NOT refund the value of any shipping paid.

 

WARRANTY RETURNS

MindSpaceX will happily honor any valid warranty claims, provided a claim is submitted within 30 days of receipt of items.
Customers may be required to pre-pay the return shipping, however we will reimburse you upon successful warranty claim. 
Upon return receipt of items for warranty claim, you can expect MindSpaceX to process your warranty claim within 7 days. In most cases pictures of the damaged goods would be sufficient. Once warranty claim is confirmed, you will receive the choice of:

(a) refund to your payment method
(b) a refund in store credit
(c) a replacement item sent to you (if stock is available)

 

Order Processing/Handling

 

IN-STOCK ITEMS

We aim to have sufficient stock to minimise the processing time for all orders. Where this is possible the order will be processed within 24 hours.

IN-STOCK ITEMS

When off-site on-demand printing is required, MindSpaceX will place the order with the vendor within 24 hours and confirm this to you via email. Once the order has been dispatched the the vendor you will again be informed. 

Delivery Terms

MindSpaceX uses UPS as its main delivery service. Shipments will be ensured and tracking will be provided. Where UPS delivery is not available, another provider will be used. When another delevery service is used, the option for insurance and/or tracking is not guaranteed.

DISPATCH TIME

Orders are usually dispatched within 2 business days of order payment.


SHIPPING TIME - 'WORLDWIDE STANDARD'

Generally, orders shipped 'standrd' are in transit for 4 – 7 days. This varies greatly depending on the destination. We are able to offer a more specific estimate at checkout.

 

SHIPPING TIME - 'WORLDWIDE EXPEDITED'

Generally, orders shipped 'expedited' are in transit for 1 – 4 days.

 

CHANGE OF DELIVERY ADDRESS

For change of delivery address requests, we are able to change the address at any time before the order has been dispatched. Simply email the changes to oders@mindspacex.com and mention clearly your order details and new shipping information. 

 

P.O. BOX SHIPPING

We are in most cases unable to offer couriers services to these locations.

 

MILITARY ADDRESS SHIPPING

We are able to ship to military addresses using USPS within the United States. We are however unable to offer this service using courier services.


ITEMS OUT OF STOCK

If an item is out of stock, we will wait for the item to be available before dispatching your order. Existing items in the order will be reserved while we await this item. During this time you are able to cancel you oder at any time for a full refund.

 

DELIVERY TIME EXCEEDED

If delivery time has exceeded the forecasted time, please contact us so that we can conduct an investigation. MindSpaceX is not liable for nor in direct control of delivery times.

 

TRACKING NOTIFICATIONS

Upon dispatch, customers will receive a tracking link from which they will be able to follow the progress of their shipment based on the latest updates made available by the shipping provider.

 

PARCELS DAMAGED IN TRANSIT

If you find a parcel is damaged in-transit, if possible, please reject the parcel from the courier and get in touch with our customer service. If the parcel has been delivered without you being present, please contact us with next steps.

 

Duties & Taxes


SALES TAX

Sales tax has already been applied to the price of the goods as displayed on the website.

 

IMPORT DUTIES & TAXES

Import duties and taxes for international shipments may be liable to be paid upon arrival in destination country. This varies by country, and MindSpaceX encourage you to be aware of these potential costs before placing an order with us.
If you refuse to to pay duties and taxes upon arrival at your destination country, the goods will be returned to MindSpaceX at the customers expense, and the customer will receive a refund for the value of goods only. The cost of the return shipping and the cost of the initial shipping will be deducted from the refund amount.

 

Cancellation

If you change your mind before you have received your order, we are able to accept cancellations at any time before the order has been dispatched. If an order has already been dispatched, please refer to our refund policy.

 

Insurance

Parcels are insured for loss and damage up to the value as stated by the courier.

 

PROCESS FOR PARCEL DAMAGED IN-TRANSIT

We will process a refund or replacement as soon as the courier has completed their investigation into the claim.

 

PROCESS FOR PARCEL LOST IN-TRANSIT

We will process a refund or replacement as soon as the courier has conducted an investigation and deemed the parcel lost.

Membership Terms and Conditions

Welcome to MindSpaceX! Please take the time to read and understand these Membership terms and conditions (Membership Terms). They govern your (your or you) use of the MindSpaceX service (Site) as a member.

Once you click “I agree”, you agree to the Membership Terms as a legally binding contract between you and MindSpaceX. If you do not want to agree to these Membership Terms, we’re sorry but our friendship will have to end there!

In these Membership Terms, Content means all the content available on the Site including tutorials, courses, videos, eBooks, sample files and user forum content.

 

Monthly Payment Plan Memberships

Applies to memberships where payments are made every month during the duration of the membership term.

You understand and agree that you have committed to a contract. And you agree to membership fees payable by you at the rate offered at purchase time every month until cancelled.

 

Cancellation of Monthly Payment Plan

You understand that you are able to cancel your membership during the trial period with our insuring any charges – as per our Free Trial offer. Please use our online form via the ‘membership’ section on our website or email member@mindspacex.com to cancel.

You understand that should you cancel your membership after of the trial, you agree to pay a cancellation fee equal to the total value of 1 months membership. In this case you will be able to avail the content in full.

All cancellations must be submitted and processed prior to next months payment. Once a payment is processed no refund is possible.  

Membership

If you are under 18 years, you need your parents’ permission before becoming a member and accessing the Site.

Your Membership is non-transferable. You must not share your username and password with anyone else or allow anyone else to access the Site using your username and password.

You are responsible for every use of the Site that occurs in conjunction with use of your username and password. You must use reasonable efforts to keep your username and password confidential. You must notify us as soon as you become aware of any unauthorised use of your membership, username or password.

Membership is based on periodic subscription fees which are detailed on the Site’s sign up page. Your membership, or access to Content and areas of the Site, will be suspended or cancelled if we do not receive the fees for your subscription type.

No subscription fee will be charged during your trial period as per our “Free Trial offer” policy. Only one (1) free trial is possible per user. You may also have rights granted to you by law which may entitle you to a refund of fees in specific circumstances. Apart from those things, refunds of subscription fees will not be made.

Availability and Use of the Site

The Site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the Site or the provision of the Site’s services and Content, for maintenance, technical or other reasons.

When accessing and using the Site and its services and Content, you must comply with directions, instructions or protocols posted on the Site.

We are pleased to be able to offer a wide range of exclusive Content on the Site for your educational and learning needs, which we aim to regularly add to. The Content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific Content will always be available on the Site.

Rights to Content; intellectual property

Each item of Content is copyright of its author. We own any MindSpaceX-contributed Content, and all other rights in the Site including its design, compilation and look and feel.

Your membership gives you a right (a revocable, non-exclusive licence) to use the Content for personal purposes.
