Bookings & Cancellations

We want your booking with us to run as smoothly as possible. In order to provide a great level of service to all of our clients and delegates, we have some terms and conditions that you will need to agree to when booking. These terms and conditions offer a level of protection to both you and our business.

How to Book

Please ensure you have read, understood and accepted the Conditions of Booking before you submit a booking. By placing a booking you will be deemed to have read, understood and accepted them, therefore entering into a contract.

To make, amend or cancel a booking please use the live booking system on our website or email us at booking@mindspacex.com.

Once this form is received and processed and you receive a booking email from us, your booking in then classed as a confirmed booking and the terms and conditions below apply. By completing this form you are entering into a contract with us.

Although your booking will be classed as confirmed on receipt of this form, your space(s) on the course you have selected will only be confirmed if you have a valid membership with no outstanding fees.

Cancellation charges may apply should you decide to cancel, whether or not payment has been received. All courses become non transferable, cancellable or refundable when there are 24 hours or less to the course start time & date except when referring to face-to-face courses/teaching where the minimum notice time is 48 hours. 

Methods of Payment

Payment of the course fees must be made in advance and should be made at the time of placing a booking or immediately after receiving an invoice. This applies to single course payments only and not to members with a current monthly membership.

Course payments can be made only via the websites online payment portal and all transactions are immediate and final.

Cancellation – Face to Face Courses/teaching

Bookings can only be cancelled by completing the cancellation form in the my account section of the website.

  • Cancellations within 48 hours of the training start time/date will be charged the full course fee or debited from his/hers allowable course balance.

  • Cancellations more than 48 hours in advance of the course will incur no charge.

  • No shows on the day without any notice will be classed as cancelling on the day.

Whether or not course fees have been paid or a client holds a monthly membership, cancellation fees will apply once the booking has been processed.

Bookings can only be cancelled via the my account section of the website.

To ensure a consistent service is provided to all, this is non-negotiable.

Cancellation – Free Webinars

Webinars can be cancelled at any time. Attendance is not necessary and access to a recording will be available for active bookings.

Course Transfer – Face to Face Courses

A confirmed booking may be transferred to another of MindSpaceX’s courses, availability permitting, providing that there is more that 2 days before the course date and the new course takes place within 1 month of the date originally booked. MindSpaceX is not obliged to ensure suitable alternatives are available.

Course Content and Programme Schedule

MindSpaceX reserves the right to alter the advertised schedule of courses, which may include cancellation of a course.

All advertised programmes require a minimum number of bookings to be placed on each course. Where this number is not reached, we may choose to cancel the course. Where MindSpaceX cancels a course, individuals with confirmed bookings on that course will be offered alternative dates. If none can be provided then a full refund will be given. If we need to cancel a course then 4 days notice will be provided.

MindSpaceX reserves the right to alter or amend the advertised content of any course without notice in order to continuously provide a high quality service or due to circumstances beyond our control.

MindSpaceX reserve the right to change the venue from that originally advertised by providing 4 days notice.

MindSpaceX will not be liable for any losses or expenses, including consequential, arising from any such alterations or amendments to the programme content and schedule including cancellation.

 

Acceptable Use of Facilities

In placing a booking you agree to abide by MindSpaceX’s Acceptable Use Policy relating to the use of MindSpaceX’s facilities. This policy requires the following:

  • None of MindSpaceX’s facilities may be used to locate, display or transmit any material which is illegal or offensive,

  • No software may be downloaded or installed on any of MindSpaceX’s computing equipment unless under the explicit direction of the MindSpaceX platfrom,

  • No data may be imported which has not been checked for viruses and which is not under the explicit direction of the MindSpaceX platform,

 

Smoking

MindSpaceX’s premises are non-smoking and all delegates are required to adhere to this policy.

Exclusion

MindSpaceX reserves the right to refuse access to its facilities and premises where there is reason to believe that a delegate is in breach of these conditions or where a delegate uses threatening, bullying, harassing or disruptive behaviour. MindSpaceX will not be liable for any losses or expense (including course fees and consequential damages) incurred by a delegate arising from such an exclusion.

Digital and Online Training Facilities

MindSpaceX will provide access to our online training platforms in order for delegates to attend an online training course.

Charges for online training are per delegate and not per connection. Where we suspect more than one person is using a connection to our digital services, we reserve the right to terminate and block the connection without refund.

We will publish the minimum software and hardware requirements for accessing our online and digital services. It is the delegates responsibility to check these prior to the course and cancel within the required timescales where these cannot be met.

Revolution Learning and Development will not be responsible for failures to connect due to software or hardware requirements not being met, internet drop-outs or failures, issues with firewalls or being unable to download the required software due to internal security policies.

Free Webinars and Other Online Services Offered Free of Charge

MindSpaceX will from time to time offer some online and digital services free of charge.

Where this is the case we use an email marketing list programme to collect and manage registrations including sending joining instructions. This data will also be added to our main marketing list and used to send further communications after the event where we think the delegate will be interested in the content. Information can be unsubscribed at any time.

 

Shipping & Returns

MindSpaceX (“we” and “us”) is the operator of (https://www.mindspacex.com) (“Website”) and (https://www.theatpbook.com) (“Website”). By placing an order through any of these Websites you will be agreeing to the terms below. These are provided to ensure both parties are aware of and agree upon this arrangement to mutually protect and set expectations on our service.

 

General

SUBJECT TO STOCK AVAILABILITY

We try to maintain accurate stock counts on our website but from time-to-time there may be a stock discrepancy and we will not be able to fulfill all your items at time of purchase. In this instance, we will fulfill the available products to you, and contact you about whether you would prefer to await restocking of the backordered item or if you would prefer for us to process a refund.

 

Shipping Costs

Shipping costs are calculated during checkout based on weight, dimensions and destination of the items in the order. Payment for shipping will be collected with the purchase. This price will be the final price for shipping cost to the customer.

 

Returns

RETURN DUE TO CHANGE OF MIND

MindSpaceX will happily accept returns due to change of mind as long as a request to return is received by us within 14 days of receipt of item and are returned to us in original packaging, unused and in resell-able condition. Return shipping will be paid at the customers expense and will be required to arrange their own shipping. Once returns are received and accepted, refunds will be processed to store credit for a future purchase or to the credit card used for the transaction. We will notify you once this has been completed through email.

(MindSpaceX) will refund the value of the goods returned but will NOT refund the value of any shipping paid.

 

WARRANTY RETURNS

MindSpaceX will happily honor any valid warranty claims, provided a claim is submitted within 30 days of receipt of items.
Customers may be required to pre-pay the return shipping, however we will reimburse you upon successful warranty claim. 
Upon return receipt of items for warranty claim, you can expect MindSpaceX to process your warranty claim within 7 days. I most cases pictures of the damaged goods would be sufficient. Once warranty claim is confirmed, you will receive the choice of:

(a) refund to your payment method
(b) a refund in store credit
(c) a replacement item sent to you (if stock is available)

 

Delivery Terms


TRANSIT TIME U.S

In general, domestic shipments are in transit for 2 – 7 days

 

TRANSIT TIME Europe

Generally, orders shipped within the European Union are in transit for 4-10 days. This varies greatly depending on the courier. We are able to offer a more specific estimate at checkout.

 

TRANSIT TIME INTERNATIONALLY

Generally, orders shipped internationally are in transit for 4 – 22 days. This varies greatly depending on the courier. We are able to offer a more specific estimate at checkout.

 

DISPATCH TIME

Orders are usually dispatched within 2 business days of payment of order.

Our warehouse operates on Sunday – Thursday during standard business hours, except on national holidays at which time the warehouse will be closed. In these instances, we take steps to ensure shipment delays will be kept to a minimum.

 

CHANGE OF DELIVERY ADDRESS

For change of delivery address requests, we are able to change the address at any time before the order has been dispatched. Simply email the changes to oders@theatpbook.com and mention clearly your order details and new shipping information. 

 

P.O. BOX SHIPPING

MindSpaceX will ship to P.O. box addresses using postal services only. We are in most cases unable to offer couriers services to these locations.

 

MILITARY ADDRESS SHIPPING

We are able to ship to military addresses using USPS within the United States. We are however unable to offer this service using courier services.


ITEMS OUT OF STOCK

If an item is out of stock, we will wait for the item to be available before dispatching your order. Existing items in the order will be reserved while we await this item. During this time you are able to cancel you oder at any time for a full refund.

 

DELIVERY TIME EXCEEDED

If delivery time has exceeded the forecasted time, please contact us so that we can conduct an investigation. MindSpaceX is not liable for nor in direct control of delivery times.

 

TRACKING NOTIFICATIONS

Upon dispatch, customers will receive a tracking link from which they will be able to follow the progress of their shipment based on the latest updates made available by the shipping provider.

 

PARCELS DAMAGED IN TRANSIT

If you find a parcel is damaged in-transit, if possible, please reject the parcel from the courier and get in touch with our customer service. If the parcel has been delivered without you being present, please contact us with next steps.

IMPORT DUTIES & TAXES

Import duties and taxes for international shipments may be liable to be paid upon arrival in destination country. This varies by country, and MindSpaceX encourage you to be aware of these potential costs before placing an order with us.
If you refuse to to pay duties and taxes upon arrival at your destination country, the goods will be returned to MindSpaceX at the customers expense, and the customer will receive a refund for the value of goods paid. The
cost of the return shipping and the cost of the initial shipping will not be refunded.

 

Cancellation

If you change your mind before you have received your order, we are able to accept cancellations at any time before the order has been dispatched. If an order has already been dispatched, please refer to our refund policy.

 

Insurance

Parcels are insured for loss and damage up to the value as stated by the courier.

 

PROCESS FOR PARCEL DAMAGED IN-TRANSIT

We will process a refund or replacement as soon as the courier has completed their investigation into the claim.

Membership Terms and Conditions

Welcome to MindSpaceX! Please take the time to read and understand these Membership terms and conditions (Membership Terms). They govern your (your or you) use of the MindSpaceX service (Site) as a member.

Once you click “I agree”, you agree to the Membership Terms as a legally binding contract between you and MindSpaceX Incorporated. If you do not want to agree to these Membership Terms, we’re sorry but our friendship will have to end there!

In these Membership Terms, Content means all the content available on the Site including tutorials, courses, videos, eBooks, sample files and user forum content.

 

MONTHLY PAYMENT PLAN MEMBERSHIPS

Applies to memberships where payments are made every month during the duration of the membership term.

You understand and agree that you have committed to a contract. And you agree to membership fees payable by you at the rate offered at purchase time every month until cancelled.

 

Cancellation of MONTHLY PAYMENT PLAN

You understand that you are able to cancel your membership in the first 7 days for a full refund – as per our Free Trial offer. Please use our online form via the ‘membership’ section on our website or email member@mindspacex.com to cancel.

You understand that should you cancel your membership after of the first 7 days, you agree to pay a cancellation fee equal to the total value of 1 months membership. In this case you will be able to avail the content in full.

All cancellations must be submitted and processed prior to next months payment. Once a payment is processed no refund is possible.  

Membership

If you are under 18 years, you need your parents’ permission before becoming a member and accessing the Site.

Your Membership is non-transferable. You must not share your username and password with anyone else or allow anyone else to access the Site using your username and password.

You are responsible for every use of the Site that occurs in conjunction with use of your username and password. You must use reasonable efforts to keep your username and password confidential. You must notify us as soon as you become aware of any unauthorised use of your membership, username or password.

Membership is based on periodic subscription fees which are detailed on the Site’s sign up page. Your membership, or access to Content and areas of the Site, will be suspended or cancelled if we do not receive the fees for your subscription type.

You can ask for a refund of subscription fees under our “Free Trial offer” policy, during the first 7days of your subscription. Only one free trial is possible per user. You may also have rights granted to you by law which may entitle you to a refund of fees in specific circumstances. Apart from those things, refunds of subscription fees will not be made.

Availability and Use of the Site

The Site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the Site or the provision of the Site’s services and Content, for maintenance, technical or other reasons.

When accessing and using the Site and its services and Content, you must comply with directions, instructions or protocols posted on the Site.

We are pleased to be able to offer a wide range of exclusive Content on the Site for your educational and learning needs, which we aim to regularly add to. The Content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific Content will always be available on the Site.

Rights to Content; intellectual property

Each item of Content is copyright of its author. We own any MindSpaceX-contributed Content, and all other rights in the Site including its design, compilation and look and feel.

Your membership gives you a right (a revocable, non-exclusive licence) to use the Content for personal purposes. You must not redistribute Content (such as tutorials, eBooks, videos, courses and source files). Any project files, spreadsheets or other assets associated with Content are included to demonstrate the course or tutorial. You may use, modify and manipulate files for your own personal educational purposes, but you must not otherwise exploit the files and the assets in them, or redistribute the files or assets. If you love the Content, please ask your friends to become members too!

You may freely use the procedures and techniques demonstrated in the Content (that is, the knowledge you gain) for any commercial or personal purpose.

The trade marks and logos displayed on the Site are, unless otherwise stated, those of MindSpaceX Inc. and others, and you must not use these without the approval of the relevant owner.

Fair use and prohibited conduct

You are permitted to download Content to your computer as part of your membership. But your membership is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of the Site and the Content must be fair, genuine and reasonable. For example, the total amount of Content you download must be reasonable in light of your genuine education and learning needs, and the time needed to genuinely engage with the Content. We will use our reasonable discretion to decide whether a member has complied with the ‘fair use’ policy.

You must not use scripts to automatically mass download Content.

You also must not:

  • Use a false email address, impersonate others, or misrepresent your affiliation with others;

  • Insert advertising, branding or other promotional content into the Site or Content;

  • Attempt to gain unauthorised access to computer systems or materials through the Site;

  • Egage in automatic gathering of information from or through the Site (such as “spidering”, “screen scraping”, “database scraping” or harvesting of e-mail addresses);

We respect the intellectual property rights of others, and require that you do the same.

Please read our Forum and Community rules, which are part of these Membership Terms and apply to content contributed to the Sites by members (such as comments, reviews and forum posts).

We reserve the right, but are not obliged, to monitor all matter posted to the Site. We are not responsible or liable for material posted by others. We do, however, reserve the right to edit, refuse to post or to remove matter that in our discretion is objectionable or in violation of these Membership Terms, our policies or applicable law.

You must not upload or post any materials that:

  • Restrict or inhibit others’ use or enjoyment of the Site;

  • Are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;

  • Infringe others’ rights, including privacy or intellectual property rights;

  • Disclose personal information about others, particularly sensitive information;

  • Contain a virus, spyware, or other harmful component; or

  • Contain commercial solicitation or ‘spam’ of any kind.

Personal information that you disclose may be used by MindSpaceX, its agents and contractors in relation to your membership and the Site, including marketing activities for the Site.

We may disclose any personal information as necessary to satisfy any law, regulation or government request.

Refusal, suspension or termination of membership

We may, in our discretion, immediately restrict, suspend or terminate your membership and access to the Site if we consider you in breach of these Membership Terms, any other Site rules, or applicable law.

We reserve the right to refuse membership in our discretion (examples include previous breaches of membership terms on any of our websites and previous utilisation of the Site’s “Moneyback Guarantee”).

Liability and disclaimer

Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these Membership Terms and are not bound by implied terms.


Except as provided in an applicable Non-excludable Law:

  • We do not promise that the Content or your access to the Site will be uninterrupted or error-free, that any defects will be corrected, or that the Site or Content are free of viruses or any other harmful components; and

Changes to Membership Terms

We may change these Membership Terms from time to time, but we will notify members before doing so. You will be given the opportunity to cancel your subscription with a pro-rata refund (based on time remaining in your subscription) if you do not want to accept the changes. If you do not opt out in this way, your continued subscription to and use of the Site will be an acceptance of the updated Membership Terms.

Applicable Laws

We control and operate the Site from our offices in Dubai, U.A.E. The laws of the U.A.E govern these Membership Terms, and you and MindSpaceX submit to the jurisdiction of the courts there.
